Florida: Shark Ravages Thigh Of Boy, 6, in Bloody Attack; Surgeons Say He'll Walk Again

By Daily Mail Reporter

|

A six-year-old boy lost three-quarters of his thigh in a bloody shark attack at a Florida beach on Tuesday.

Nickolaus Bieber, from Palm Beach Gardens, was swimming near the Juno Beach Pier in Jupiter at about 7pm when he saw the shark 'thrashing in the water'.

The creature then surged at him, gnawing a chunk out of his leg.

'He was bleeding so much that we couldn't tell which part of the body was bit,' an onlooker told WPTV.

Nickolaus' mother, Christina Bieber, said she initially thought her son had been stung by a Portuguese man-of-war when he turned to her and said 'something bit me'.

?

'I didn't know what it was, but I knew it was bad,' she told The Palm Beach Post.

She said she wrapped a towel around her son's leg where a 'good chunk' was torn off and passers by called 911.

In audio of the emergency call released on Wednesday, the caller describes the bite as a 'pretty big gash' and adds that the boy was 'bleeding pretty bad'.

The bite to Nickolaus' upper back thigh was about 12 inches in circumference, covering about three-quarters of his right thigh and came very close to the bone.

But the shark managed to avoid major vessels and nerves, according to surgeons at St. Mary?s Medical Center, where the boy was flown by Trauma Hawk.

Dr David Rankin said plastic surgeons replaced the missing tissue and so far the replacement tissue has taken.

He and Dr Michael West, a trauma surgeon, said the boy was lucky to be alive.

'He?s a very luck individual,' Dr West told The Post. 'This was a significant shark bite when compared to the size of his leg.'

Nickolaus will spend at least a week in hospital but he is expected to be walking again within a month.

Authorities haven't confirmed what type of shark bit the boy, although they suspect it may have been a bull shark.

Ms Bieber said her son was brave during the attack and was now recovering well.

'He was calm, he was alert the whole time,' she said in a press conference.

'He's alert now. He's heavily medicated but he's doing OK and he's in good spirits and people who know my son, he's tough.'

Matthew Bieber, Nickolaus' father, said it was 'pretty impressive' how the wound was stitched up. 'It gives us a lot of hope,' he said.

Nickolaus was swimming with his sibling in waist-deep water when the attack occurred. His parents said the family visited the beach regularly.

Ms Bieber described the attack as a 'freak accident' and urged parents and kids not to be afraid of the water.

Brotherhood shelves Egypt's Islamization, for now

CAIRO (AP) ? The Muslim Brotherhood has stopped talking about its longtime dream of an Islamic Egypt and expelling Israel's ambassador to Cairo. Instead, President-elect Mohammed Morsi is hurriedly building a diverse alliance with leftists, liberals and Christians to bolster his battle to end military rule.

Those familiar with the group's inner workings say, however, that this may only be a short-term strategy that will give way later to a push for the stricter imposition of Islamic law. That could partly explain why the secular generals who took over from ousted President Hosni Mubarak 16 months ago will not relinquish their hold on most levers of power.

Less than a week after he was declared winner of a hotly contested runoff, Morsi has promised to name a woman and a Christian as vice presidents, held talks with liberal intellectuals, indirectly assured Israel that it has nothing to fear from him and told Washington that maintaining close relations with the U.S. is a priority.

Since qualifying for the June 16-17 presidential runoff, Morsi has made no mention of the Muslim Brotherhood's traditional positions, such as banning alcohol, forcing women to cover up in public or prohibiting bank interest as usury.

"The Brotherhood wants to take on the generals, but it cannot do that alone," said Khalil el-Anani, an expert on Islamic groups from Britain's Durham University. "It is a necessity for the Brotherhood to offer concessions to different groups."

But no one is taking Morsi's promises at face value. Some Christian and liberal groups have set up teams to monitor whether he keeps his promises.

"They will just have to work with him and the Brotherhood for now and hopefully try to organize a secular leftist front that will pressure the new government and new parliament to make sure the demands of the street are taken into account in the public policymaking process," said Azzedine Layachi, a Middle East expert at St. John's University in New York.

The "new" Brotherhood as embodied by Morsi has left many debating whether the group has had a genuine, long-term shift of ideology dictated by the demands of politics or was simply making the right noises to win allies and would shift back to its longstanding goals at the next opportunity.

Some analysts see Morsi, a 60-year-old, American-trained engineer, as a conservative Islamist who subscribes to a school of thought within the Brotherhood that advocated "Taqiyah," or secrecy, about one's true intentions until the most opportune moment comes for their implementation.

Others, however, see Morsi's outreach as the group's response to a dramatic drop in its popularity after it failed to turn its domination of parliament earlier this year into real political power. They also cite the group's lack of experience in governance to explain its need for allies.

Genuine or not, some of the group's actions in recent weeks appeared designed to allay fears of what many see as the Brotherhood's lust for power and readiness to make secret deals to secure it.

Having spent most of the 84 years since its inception as an outlawed group targeted by successive governments, the Brotherhood's keen interest in power ? some call it an obsession ? may be understandable.

But it may have over-reached, unleashing the fury of the generals.

It won just under half of parliament seats in elections held some six months ago even though it had earlier pledged to contest only 30 percent of them. It also reneged on a decision not to field a presidential candidate, and packed with Islamists a 100-member panel tasked with drafting a new constitution.

At the time, Brotherhood lawmakers gave the military and many Egyptians something to worry about. They sharply criticized the judiciary and the police force, demanded the expulsion of Israel's ambassador in Cairo and called for a national referendum on the 1978 Camp David accords, which provided the basis for Egypt's 1979 peace treaty with Israel. But it was its suspected desire to dominate every vestige of authority that provoked the military.

The generals dissolved parliament after a court ruled that a third of its seats were elected under a law that breached the principle of equality. The constitutional panel was also dissolved by a court ruling that said the process of selecting members violated a constitutional declaration adopted in March last year.

The Brotherhood again packed the panel with Islamists but has sought to make amends by giving its chair and two deputies to non-Islamist figures.

Ammar Ali Hassan, an Egyptian expert on Islamist groups, says the Brotherhood's newly adopted moderate tone and Morsi's outreach are motivated in large part by their desire to share the blame if the new government fails to make headway in tackling the country's seemingly endless problems.

"All this, however, could be temporary until Morsi's feet are firmly in the ground as president," he warned. "Morsi will never disengage from the Brotherhood and its longtime objectives. For one thing, he can only be loyal and grateful to the group that backed him all the way to the presidency."

Morsi was not the first choice for presidential candidate, having been thrown into the race after the group's chief strategist and financier, Khairat el-Shater, was disqualified over a Mubarak-era conviction.

Morsi's attempts to position himself and the Brotherhood as moderates seeking inclusion apparently have not convinced the military. Two senior members of the ruling military council indicated in a television interview late Wednesday night that they and other generals were not prepared to cede any of their powers.

They both insisted that there would be no going back on a "constitutional declaration" issued last week that gave the military legislative powers and control over foreign affairs as well as the drafting of a new constitution.

The armed forces, said Maj. Gen. Mahmoud Hegazy, will continue to be the "trustworthy guardian" of the nation and its people. When pressed to explain what the role of "guardian" will entail, Maj. Gen. Mohammed el-Assar abruptly chipped in: "interpret it any way you like."

The final word was Hegazy's. The military, he said, would protect the country from external as well as domestic threats.

Michael W. Hanna, an Egyptian-American expert on Egypt at the Century Foundation in New York, said "the military's recent steps suggest they are unlikely to turn over all the levers of governance to the Islamists, regardless of any future efforts by Morsi to assuage the fears of other political factions and parties."

The Brotherhood's apparent plan to shelve Islamization, at least for now, comes at a cost.

Already, some ultraconservative Salafi groups have publicly said that their participation in a Morsi administration is conditional on his declaring his commitment to implementing Shariah, or Islamic law. The Salafis won about a quarter of the seats in the dissolved parliament.

Abandoning their goal of turning Egypt into an Islamic state, according to Hassan, could also cost the group the support of its hardline faction, which has long objected to its involvement in politics at the expense of its original mandate as a charity that helps Muslims to understand their faith and practice its many rituals.

Hassan, el-Anani and others trace the causes of the Brotherhood's shift to the dramatic drop in support for the group in the first round of the presidential elections held in May. Morsi won about 25 percent of the vote, or half the votes won by the group in the legislative elections five months earlier. In the runoff against Mubarak's last prime minister, Ahmed Shafiq, Morsi edged his rival by about 1 million votes, a narrow victory for a group that claims to be the country's largest.

"The group's leaders met and did some soul searching," el-Anani said. "They realized that they were out of touch with the new environment in Egypt and decided they can only survive if they reached out to other political forces."

vance - Every Day Is A Healthy Day With These Wonderful Weight ...

by author on June 27, 2012 in lose belly fat

Try to find a low-calorie substitute of the foods you like the best. It?s not uncommon for someone to give their diet up because they are dealing with hunger pains, or because they?re unable to stay away from their favorite types of food. You can enjoy your favorite foods in lower-caloric versions and lose weight at the same time.

Eating while distracted is the key to weight gain. If you don?t pay attention to your diet, you will probably eat more than you intend. Therefore, you should keep track of the amount of food you are eating during every meal. This will help you ensure you don?t overeat.

Green vegetables are an integral component to add to your diet regimen. Green vegetables are filled with fibers, vitamins, minerals and nutrients. Some great greens include spinach, broccoli, green beans, asparagus, and kale. When you add these to your meal plans, you will see results.

Always have healthy snacks on hand. This can include nuts, cheese and veggies. These healthy choices are great for times when you are hungry for a snack and want to avoid junk food. It makes a quick and easy snack you can grab when you are on the go.

Reduce your alcohol intake as much as possible when trying to lose weight. It can be harder to lose weight if you drink a good bit of alcohol. Alcoholic beverages are usually loaded with empty calories. If you?re going to drink, try a low calorie version of the original.

To stick with losing weight more easily, you should figure out which types of physical activity makes you happy. This can help you burn the calories quicker, so you can eat more. If you can enjoy the activity, you won?t feel bad about it and consider it work; in turn, you will feel more motivated to keep going.

It is not hard to lose the weight. The first thing to do is cut certain foods from your diet. Replacing sugary sodas and juices with water or low calorie beverages is an essential step in controlling your weight. Sometimes, juices low in sugar are alright to consume, but sodas and soft drinks should not be consumed at all.

If you consistently find yourself at a loss, consider hiring a consultant or other nutritional or fitness professional to help you. Professionals can help people prepare their grocery lists, recipes, and more. This helps to reduce the extra effort involved in planning for a diet regimen.

While you are in weight loss mode, it is wise to purchase clothing at discount stores and thrift stores. This is because you want to avoid spending lots of money on clothing during your weight loss regimen that will soon be too big for you.

Taking pictures of yourself both before weight loss and during can help your progress. This can give you a glimpse into your progress or lack thereof during your regimen. Of course, this also makes it easier for you to share your progress with others.

An easy way to help lose weight is to reduce the size of the plate you use. Large plates can cause people to fill the plate to capacity and eat more than is necessary. Use a 9? plate for your dinnertime meal. Larger plates are simply too large for successful weight loss.

Be realistic when you?re setting a goal for losing weight. It is unrealistic to think that you would lose 50 pounds, for example, in less than six months. By creating realistic smaller goals, you will stay motivated as you meet each goal. You will not fail if you do not set yourself up to do so. Give yourself a weekly weight loss goal of around two pounds.

Investigate foods that are high in monounsaturated fatty acids, which have been shown to increase the success rate of healthy weight loss. MUFA means monosaturated fatty acids and this can be oils, butters and nuts because they?re counted in that group. In studies, MUFA foods increase the amount of weight you lose, and also increase your overall health as well. Use MUFA foods appropriately in your diet.

Instead of consuming large evening meals, try eating the large meals midday. If you normally eat a sandwich for lunch, change it up and eat it for supper, instead. Eating your largest meal for lunch will give you more calories when you need them. Calories consumed in the evening are less likely to be burned off.

One great exercise that promotes weight loss is climbing the stairs. As simple as it may seem, you are still burning calories that you would not have had you taken the elevator.

When you begin your diet, establish realistic goals. If your goal is not realistic, it won?t be met. You won?t succeed if you determine that you need to lose 20 pounds in a month?s time. Rather than setting unrealistic goals, set smaller attainable goals each week. Stop focusing on the big picture. Instead, you should be concerned with how much you lose every week.

Simple behaviors are easier to sustain to successful conclusions. Keep what you have learned here in mind, and practice these new skills. You will see this becoming effective in making you thinner pretty quickly. In a matter of weeks, you will have developed the healthy habits that are going to bring your to your ideal weight.

WASHINGTON (AP) ? Congressional leaders have reached tentative deals that would prevent a doubling of student loan interest rates and revamp the nation's transportation programs, congressional officials said Wednesday. If completed, the compromises would resolve two vexing issues on which lawmakers face weekend deadlines for action.

House and Senate leaders have tentatively agreed to a one-year extension of today's 3.4 percent interest rates for subsidized Stafford loans, said a congressional Republican who spoke on condition of anonymity to reveal the issue's status. The measure ? which would affect 7.4 million students projected to get new loans starting July 1 ? is the same package that Senate Majority Leader Harry Reid, D-Nev., and Senate Minority Leader Mitch McConnell, R-Ky., said Tuesday they had crafted between themselves.

At the same time, congressional leaders have tentatively agreed on a two-year bill to overhaul federal highway programs, Senate aides said. The government's authority to spend money on highways, bridges and transit systems expires Saturday, as does its ability to levy gasoline and diesel taxes. They spoke on condition of anonymity because the deal wasn't final.

Sen. James Inhofe, R-Okla., top Republican on the Senate Environment and Public Works Committee, said bargainers would drop a requirement that the government approve the proposed Keystone XL oil pipeline that is to run from Canada to Texas. House Republicans had pushed for inclusion of the Keystone provision, but the White House threatened to veto the bill if it was included.

Inhofe said another GOP provision blocking the federal government from regulating the toxic ash generated by coal-fired power plants would also be jettisoned.

House Republicans won concessions from the Senate on environmental reviews of highway projects, Senate aides and environmentalists said.

Critics have complained that requirements for environmental impact statements before highway construction projects can proceed have caused unnecessary delays and driven up costs. Under the agreement, the average time it takes to complete a highway project would drop from 15 years to about eight years, they said.

The agreement also makes other kinds of transportation programs eligible for the same pool of money that funds transportation enhancements, which means there will probably be less money to go around for biking and walking projects, they said.

The aides said they were working to put the agreement into legislative language, which must happen before House and Senate leaders formally sign off on the deal.

Congressional leaders are talking about combining the highway and student loan measures into a single bill to reduce potential procedural obstacles, and hope to vote final approval this week. Lawmakers hope to then leave Washington for a July 4 recess.

Earlier Wednesday, House Speaker John Boehner, R-Ohio, told reporters that lawmakers were moving toward an agreement on the highway and student loan issues.

Boehner made his remarks a day after Reid and McConnell said they'd struck a bipartisan agreement that the White House later said it supported. Those statements put pressure on Boehner to accept the deal, which if enacted would avoid antagonizing millions of students and their parents in an election year.

President Barack Obama highlighted the student loan issue during visits to college campuses this spring amid a campaign year in which the struggles of many families to cope with the limp economy has been a defining issue. Hoping to prevent him from using the dispute in the fall campaign, GOP presidential challenger Mitt Romney said in April that he backed an extension of the lower rates. GOP congressional leaders said the same.

In recent weeks, the key dispute has been over how to pay the student loan bill's $6 billion price tag.

Under the agreement, the government would raise $5 billion by changing the way companies calculate the money they have to set aside for pensions. That change would make their contributions more consistent from year to year, in effect reducing their payments initially and lowering the tax deductions they receive for their pension contributions.

Another $500 million would come from increasing the fees companies pay for the government to insure their pension plans, linking those fees to inflation.

In addition, $1.2 billion would be saved by limiting federal subsidies of Stafford loans to six years for undergraduates.

The White House threatened to veto a House-passed bill extending the lower interest rates because it was paid for by cutting a preventive health care program that Obama helped create. Republicans blocked a Democratic version in the Senate paid for by boosting taxes on owners of some privately held corporations.

Congressional leaders are discussing combining the student loan bill with the highway legislation. Any extra funds raised by the student loan measure could help pay for the highway legislation.

The last long-term transportation bill expired in 2009. Congress has kept programs going through a series of nine short-term extensions.

The bill would overhaul transportation programs, giving states more flexibility in how they spend federal money, step up the pace of road construction by shortening environmental reviews, impose new safety regulations and boost funding for a federal loan guarantee program aimed at increasing private investment in highway and other transportation construction projects.

The Senate passed a bipartisan, $109 billion transportation bill in March. House Republicans were unable to pass their own comprehensive transportation bill because of divisions in their party.

Instead, they passed a three-month extension of current programs coupled with controversial provisions that would have required the government to approve the Keystone XL oil pipeline and blocked the Environmental Protection Agency from regulating the toxic ash created by coal-burning power plants.

Rebels storm Pro-Assad Syrian TV channel

BEIRUT (Reuters) - Gunmen stormed a pro-government Syrian TV channel headquarters on Wednesday, bombing buildings and shooting dead three employees, state media said, in one of the boldest attacks yet on a symbol of the authoritarian state.

President Bashar al-Assad declared late on Tuesday that his country was "at war". U.S. intelligence officials said the Syrian government was "holding fairly firm" and digging in for a long struggle against rebel forces who are getting stronger.

The dawn attack on Ikhbariya television's offices, located 20 km (15 miles) south of the capital, as well as overnight fighting on the outskirts of Damascus showed 16 months of violence now rapidly encroaching on the city.

Ikhbariya resumed broadcasting shortly after the attack that killed three journalists and four security guards, displaying bullet holes in its two-storey concrete building and pools of blood on the floor. One building was almost entirely destroyed.

"I heard a small explosion then a huge explosion and gunmen ran in. They ransacked the offices and entirely destroyed the newsroom," an employee who works at the offices in the town of Drousha told state media at the scene.

Syrian media are tightly regulated by the Ministry of Information. Although Ikhbariya is privately owned, opponents of Assad say it is a government mouthpiece.

After Tuesday's fighting unprecedented in its intensity around Damascus, violence appeared to ease off around the capital following the attack on the television complex. But rebel forces were clearly becoming stronger and more ambitious.

SYRIA "AT WAR"

During the pro-democracy revolt against the Assad family's four-decade rule, Ikhbariya has been pushing to counter what it says is a campaign of misinformation by Western and Arab satellite channels on the uprising that began in March 2011.

"We live in a real state of war from all angles," Assad told a cabinet he appointed on Tuesday, in a speech broadcast on state television. "When we are in a war, all policies and all sides and all sectors need to be directed at winning this war."

The declaration marks a change of rhetoric from Assad, who had long dismissed the uprising against him as the work of scattered militants in "terrorist gangs" funded from abroad.

The rambling speech - Assad also commented on subjects as far afield as the benefits of renewable energy - left little room for compromise. He denounced the West, which "takes and never gives, and this has been proven at every stage".

International mediator Kofi Annan said he had convened a ministerial-level meeting on Syria in Geneva on Saturday with the aim of seeking an end to the violence and agreeing on principles for a "Syrian-led political transition".

In a statement, the joint United Nations-Arab League envoy said he had invited foreign ministers from the five major powers - Britain, France, China, Russia and the United States - as well as Turkey, the European Union, Iraq, Kuwait and Qatar.

Despite the deterioration in Syria, so far there has been no sign of an appetite for full-scale Western intervention. However, last week's shooting down of a Turkish warplane by Syrian air defenses has focused attention on a volatile situation on Turkey's southeastern border with Syria.

"We will not refrain from teaching a lesson to anyone trying to test Turkey's greatness," Turkish Prime Minister Tayyip Erdogan said on Wednesday, referring to the incident near the countries' maritime borders.

Turkey's land border territories, hosting over 33,000 refugees and units of the rebel Free Syria Army (FSA), are quickly becoming a potential flashpoint. Tuesday's comments by Erdogan may if anything have added further uncertainty to the situation there.

Erdogan said on Tuesday that Syrian military elements approaching the border and posing a threat would be deemed a military target. He made no public clarification of new terms of engagement issued to troops.

"With Tayyip Erdogan's announcement, and if Syria complies with it, Turkey will have by itself declared a de facto 'buffer zone'," Radikal newspaper columnist Cengiz Candar wrote.

"And if Bashar al-Assad doesn't comply with this? That is, if he continues to send soldiers right up to the border? Turkey runs the risk of a military operation against him."

Turkey has in the past spoken of possible establishment of a 'humanitarian corridor' on Syrian soil - a venture that would inevitably require armed protection. But it has always insisted such a measure, if required by a rising tide of refugees or by evidence of massacres, would need international endorsement

United Nations investigators said on Wednesday Syrian government forces had committed human rights violations, including executions, across the country "on an alarming scale" during military operations in the past three months.

The report by the U.N. Human Rights Council, issued in Geneva, also listed killings and kidnappings by armed opposition groups trying to topple President Assad.

"The situation on the ground is dangerously and quickly deteriorating," the report said.

Syria's ambassador dismissed the accusations and threatened to end cooperation with international agencies.

The United Nations accuses Syrian forces of killing more than 10,000 people during the conflict, which began with a popular uprising and has built up into an armed insurgency.

DIGGING IN FOR LONG HAUL

Despite some military defections, mainly from low to mid-level ranks, Assad's inner circle remains cohesive and the war is still likely to be a drawn-out struggle, senior U.S. intelligence officials said, in an assessment dimming any U.S. hopes that Assad will fall soon.

"Our overall assessment ... would be that we are still seeing the military regime forces fairly cohesive, they've learned some lessons over the last year and a half about how to deal with this kind of insurgency," an official said.

The insurgency is also getting stronger, he said.

"Both sides seem to be girding for a long struggle. Our sense is that the regime still believes it can ultimately prevail or at least appears determined to try to prevail and the opposition at the same time seems to be preparing for a long fight."

A claim not filed or properly asserted within the applicable time period is considered ?time barred?, or ?stale?, and is subject to dismissal in its entirety.? A few important things to remember about Statutes of Limitation and Repose are that:

1. Time Periods are Short and sometimes Ambiguous.

2. Always consult an attorney if you are not POSITIVE about how to calculate them.? Any reputable attorney will do a free statute of limitation analysis for you.

3. Our law firm turns down more cases than we take, and the primary reason is missed statutes of limitation.

There are four main types of construction defect claims brought in Minnesota, each with its own Statute of Limitation requirements:

1.? ?327A? Statutory Warranty Claims for homes or condo/townhome units: A homeowner has only 6 months within which to give written notice of the defect to the builder once the defect has manifested itself.? An action must be commenced within two years of when the defect was known, or should have been known.

2.? ?515B? Express and Implied Warranty Claims under the Minnesota Common Interest Ownership Act:

a. On homes or condo/townhome units, the statute runs (regardless of anyone?s knowledge of the claim) 6 years from the earlier of:

(i)Transfer of title to the first purchaser; or

(ii)The time the purchaser takes possession of the unit.

b. On common elements in a condo/townhome community:? The statute runs (regardless of anyone?s knowledge of the claim) 6 years from the later of:

(i) Completion of the common element;

(ii) The first unit sale; or

(iii) Termination of Declarant control.

**These time periods can be shortened by the Declarant to as little as 2 years, so complete review of the CC&Rs, purchase contracts, etc. is needed.**

3. ?General Negligence or Breach of Contract Claims

a.? Negligence: 2 years after the manifestation of the defect.

b.? Breach of Contract: 2 years after the builder fails to fulfill the warranty.

4. ?Fraud? or Misrepresentation:? 6 years after discovery of the facts constituting the misrepresentation.

?

A few more general principles to consider when calculating and evaluating Statutes of Limitation:

1. The clock typically starts when you ?knew or should have known? of the defect. That is, when the damage starts to manifest, even if you don?t know the cause yet.

2. You may, or may not get a separate 2 year statute period for each defect, or even for each location of the defect.

3. ?Working with the builder? may, or may not toll (pause) the statutes of limitation.

Statutes of Repose apply to bar a claim whether you know about the defect(s) or not. The Statute of Repose is considered an ?absolute? time bar. Again, each type of legal claim comes with its own calculation:

1.? ?327A? Warranty claims: The time periods start running upon unit purchase or occupancy, whichever is earlier.

???? 1 year ? general workmanship and materials

???? 2 years ? electric, plumbing, HVAC, etc.

???? 10 years ? ?major construction defects?

2.? ?515B? MCIOA common element warranty claims: 6 years from the later of: (i) completion of the common element; (ii) the first unit sale; or (iii) termination of Declarant control.? However, this can be shortened ?by a community?s Declarant to as little as 2 years in the project documents, so a complete review of CC&Rs, purchase and sale agreements, etc. is necessary.

3.? Contract, Negligence, or Fraud Claims: 10 years from ?substantial completion? ? when the improvement could be occupied or used for its intended purpose.? Can be extended up to 12 years when the defect manifests in year 9 or 10.

Will Mobile Cell Phones Cause Severe Problems With the ...

Mobile cell phones are the fasted growing and hottest electronics on the market today. At least 80% of every household has at least one cell phone. Cell phones are not lethal to human health but are to the environment.

Cell phones contain many harmful chemicals such as Cadmium and Lead. These are two of the most serious chemicals that can damage this environment. Are you thinking that what can a few phones do to this world? They are doing damage this second. Every year 80 million phones are bought and that number is growing even more rapid as new companies rise and phones day by day get cheaper. Nowadays, users can get phones for less than $10 or even free! All these phones contain harmful chemicals that will damage our environment if not taken care of.

Well our government and private companies have come together to allow us the opportunity to Recycle our Cell Phones. These recycling programs will safely reuse and recycle the phones so that 80 million phones a year can be made from already made phones. This will dramatically help our environment because new phones with new materials will be less likely. When using these programs, people will be compensated. Most of the recycling companies provide users with money for their phone. The companies look at the market value of the phone and determining on that pay for the phone. Usually they pay more than market value because of the incentive that you are recycling.

So you are helping the environment and getting money for it. Not a bad deal! Recycling is important, it needs to be done or severe consequences will occur. Let us help our world today. Recycle your phone, save the world, and get money at the same time!

Some Skill Sleep Learning May Work

Hearing material while sleeping that you've already learned may improve sensorimotor skills related to the execution of the material. Christopher Intagliata reports

Remember those educational cassettes that you?d supposedly learn from overnight? Well, scientific evidence says they're bunk?unless you listen to them while you?re up during the night, that is.

But if you?re actually sleeping and you play something that you've already learned, like a piano melody you've been practicing, you may indeed master it more quickly. So says a study in the journal Nature Neuroscience. [James Antony et al., "Cued memory reactivation during sleep influences skill learning" (link to come)]

Researchers asked volunteers?with and without musical experience?to learn a few random melodies on a computer keyboard.? Then the subjects took a 90-minute nap. When they slipped into slow wave sleep?a stage previously shown to be associated with memory processing?the researchers softly played back one of the two melodies.

After the subjects woke up, they were able to both melodies more accurately?the helpful effects of a little shuteye, the researchers say. But the volunteers did even better on the ditty they'd heard while snoozing, suggesting sensorimotor skills can be fine-tuned by exposure during sleep.

The scientists stress that the procedure is no shortcut to becoming Scott Joplin?you still have to put in effort while awake. But a little sleep-time study may help you change your tune for the better.

Roy Nelson challenges Mike Russow to a win or leave (the heavyweight division) bout

In a heavyweight division of the UFC filled with fighters are who built like a Greek god, Roy Nelson and Mike Russow don't exactly fit the mold.? After watching Fabricio Werdum knock out Russow at UFC 147, Nelson was struck with matchmaking inspiration.

"I want Mike Russow and loser goes to 205 or becomes Dana White Rich. Let make it happen @danawhite," Nelson tweeted.

Both men appear to carry more body fat than most of their counterparts and look like they could cut down a weight class. They also both have recent losses to Werdum, as Nelson dropped a decision to him in February.

This isn't the first time Nelson has contemplated a drop down. In March, he said he would try to get to light heavyweight if he added 100,000 Facebook likes. However, he abandoned the plan when he was booked for the all-heavyweight main card at UFC 146.

A drop for Russow, who weighed in at 246 lbs. for UFC 147, may be a bit more difficult than for Nelson. In addition to being a pro fighter, he is a full-time officer in the Chicago Police Department. He doesn't train full-time, like Nelson does.

Of course, the difficulty in dropping down would also give Russow more motivation to win the fight. Do you want to see this fight? Speak your mind in the comments, on Facebook or on Twitter.

Most commonly mutated gene in cancer 'may play role in stroke'

Researchers have found that the gene p53, which is the most commonly mutated gene in cancer, has a novel role in the development of ischemic stroke.

p53 is dubbed the "guardian of the genome" because it blocks cells with damaged DNA from propagating and eventually becoming cancerous.

However, new research led by Ute M. Moll, M.D., Professor of Pathology at Stony Brook University School of Medicine, and colleagues, uncovers a novel role for p53 beyond cancer in the development of ischemic stroke.

The team identified an unexpected critical function of p53 in activating necrosis, an irreversible form of tissue death, triggered during oxidative stress and ischemia.

Ischemia-associated oxidative damage leads to irreversible necrosis which is a major cause of catastrophic tissue loss.

Elucidating its signalling mechanism is of paramount importance. p53 is a central cellular stress sensor that responds to multiple insults including oxidative stress and is known to orchestrate apoptotic and autophagic types of cell death.

However, it was previously unknown whether p53 can also activate oxidative stress-induced necrosis, a regulated form of cell death that depends on the mitochondrial permeability transition pore (PTP) pore.

"We identified an unexpected and critical function of p53 in activating necrosis: In response to oxidative stress in normal healthy cells, p53 accumulates in the mitochondrial matrix and triggers the opening of the PTP pore at the inner mitochondrial membrane, leading to collapse of the electrochemical gradient and cell necrosis," Moll said.

"p53 acts via physical interaction with the critical PTP regulator Cyclophylin D (CypD). This p53 action occurs in cultured cells and in ischemic stroke in mice," Moll said.

They found in their model that when the destructive p53-CypD complex is blocked from forming by using Cyclosporine-A type inhibitors, the brain tissue is strongly protected from necrosis and stroke is prevented.

"The findings fundamentally expand our understanding of p53-mediated cell death networks.

"The data also suggest that acute temporary blockade of the destructive p53-CypD complex with clinically well-tolerated Cyclosporine A-type inhibitors may lead to a therapeutic strategy to limit the extent of an ischemic stroke in patients," Moll said.

Yusuf A. Hannun, M.D., Director of the Stony Brook University Cancer Center, also commented on the role of p53.

"p53 is one of the most important genes in cancer and by far the most studied," Hannun said.

"Therefore, this discovery by Dr. Moll and her colleagues in defining the mechanism of a new p53 function and its importance in necrotic injury and stoke is truly spectacular," he added.

The study has been published online in Cell. (ANI)

After slow start, Landon Donovan gives Galaxy a spark

One hundred thousand or 200,000 miles seem to be the milestone for the typical car to slow down, after a long life of service to its owner.

What is the parallel in a soccer player's career? Do you judge by years or games played?

Galaxy midfielder Landon Donovan turned 30 in March. During the past decade, he's played in roughly 350 matches that include Major League Soccer and international competitions.

Though Donovan can hardly be considered typical, it was only natural to question how much longer he can be an elite player after a slow start this season for the Galaxy. He scored just two goals in his first 11 games after averaging just a shade under a goal for every two games played during his 12-year MLS career.

Even Donovan hinted at a decreasing passion for the game when talking to reporters at the U.S. national team training camp in May.

"I think all players reach a point in their career where it's natural to lose some of that hunger, that desire, to sort of break out or be a star," he said. "My mind-set now is I want to be successful, and I realize now that as I'm getting older, I'm not going to be the guy who's scoring goals every game or making a great impact all the time."

Donovan has sparked the Galaxy in consecutive wins as the defending MLS champions attempt to crawl back into position to make the playoffs.

With L.A. down, 2-0, Wednesday at Real Salt Lake, the Galaxy fought back to win, 3-2, thanks to Donovan's two goals, and gain a much-needed three points. It was the first time in club history that Real Salt Lake had surrendered a two-goal lead at home.

"I'm doing the same thing," Donovan said after the team's workout Friday. "I'm trying to be a good teammate and a good captain and help this team win.

"I want us to keep playing the way we've been playing. Since the day I've been back, there's been a different mentality and attitude, and we need to continue that. We're still in a big hole, and we've got to make sure we keep winning."

After snapping a seven-match winless streak with consecutive victories and losing various players to rehab, injury, suspension and international duty, the Galaxy might have turned a corner.

Going into Saturday's game against Vancouver, the Galaxy, with a 5-8-2 record, are two points behind Colorado Rapids for the final playoff spot in the Western Conference.

Galaxy Coach Bruce Arena said his squad is playing more like the team they were expected to be entering the season, and that much of that is due to Donovan's leadership.

"He's certainly shown since he returned that he wants to lead this team and be successful," Arena said, adding that there's "no question" he has played more inspired in recent weeks.

Only time will tell how many miles Donovan has left in the tank, but if the past couple of weeks are any indication, he still has quite a few rides left in him.

Giving to religious institutions drops for second year in a row. Why?

Giving to religious groups has slipped by a cumulative 3.7 percent since 2010. Still, religion remains America?s favorite charitable cause, with $95.88 billion in donations.

Church congregations may need to pass the offering plate again because giving to religious institutions has dropped for the second year in a row.

Charitable giving to the religious sector fell by 1.7 percent last year, according to the Giving USA 2012 report released this week. Since the start of 2010, giving to religious groups has slipped by a cumulative 3.7 percent (not adjusted for inflation).

This shows religion to be lagging in the evermore intense competition for donor dollars, even as other nonprofit sectors gain. Total charitable giving rose by 4 percent in 2011 to $298.4 billion. Of the eight sectors tracked by Giving USA, seven saw donations rise in both 2010 and 2011. Only religion lost ground.

Why is religion having a hard time?

?Declining attendance at religious services is part and parcel to the issue? of struggling to maintain or increase giving levels, says Robert Evans, a Philadelphia fundraising consultant for nonprofits and an author of the Giving USA 2012 report. ?If you have fewer people coming through the front door, then how do you do it??

But despite cutbacks in giving, religion remains America?s favorite charitable cause. With $95.88 billion in donations, faith-based organizations still collect far more than any other nonprofit segment. A distant second is education with $38.9 billion, followed by human services at $35.4 billion.

Yet religious institutions could be witnessing the start of a long-term slide, observers say. Precipitating factors, such as a weak economic recovery, portend more financial stress and hard choices about where institutions should cut in years ahead, according to David Roozen, director of the Hartford Institute for Religion Research at Hartford Seminary in Connecticut.

?The recession exacerbated downward pressure on church finances,? Mr. Roozen says. ?You?ll likely see a continuation of this? as unemployment and wage stagnation limit how much churchgoers can give.

Large congregations have fared best in the recession?s aftermath, Roozen says, as they consume a larger share of a shrinking pie. Slumping donations have translated into painful staff cuts for small congregations and denominational offices. In one telling sign, the United Methodist Church this year did away with its longstanding policy of guaranteeing appointments for clergy as churches come to rely on fewer pastors and part-timers for ministry.

Shrinking attendance isn?t all that?s hampered the faithful?s fundraising efforts, according to Mr. Evans. Religious institutions have largely failed to keep pace with other types of organizations, such as colleges and hospitals, in deploying professional development teams. Synagogues that employ professional fundraisers have found the investment pays off, Evans says, but most congregations have no one trained in the art of asking for money.

?There?s no donor fatigue,? says Evans, who is managing director of EHL Consulting Group. ?But houses of worship ... need to fine-tune their message more strongly for the people who want to make this a better country.?

What?s more, religious institutions are exempt from financial disclosure requirements that bind other nonprofits. As donors become more discreet and sophisticated, Evans says, they?ve come to expect more transparency than religious bodies are used to supplying. Donors who value transparency might therefore respond more favorably to nonreligious appeals.
